Using Predecessor in your content

The Terms of Use outlined on this page for all content creators as well as those within the Predecessor Creator Guild program(Creator Guild) is entered into by you (content creator) and Omeda Studios of 7 Maplewood Court, 31 Eastbury Avenue, Northwood, England, HA6 3LL and its affiliates (collectively, “Omeda”).

Subject to the following Terms of Use and our Code of Conduct, we allow you the creation, uploading and monetization of your posts, photos, videos, blogs, stories, and related materials and content (“Content”) containing Omeda Property (as defined hereinafter) and Omeda products (including sequences thereof) and brands on video and streaming and/or social media platforms.

We expressly emphasise the fact that the right to use and monetize Omeda Property is only allowed in connection with your Content and through your own channel/social media account. Any other use of Omeda Property, including, but not limited to, selling or sublicensing Omeda Property, use of the Property for purposes other than creating your Content, use of Omeda Property for advertising of products from third parties or in connection with products from other parties etc., is strictly prohibited.

General Guidelines

The following guidelines and rules apply to all Omeda Studios products and Omeda Property provided by us to you without additional charge for the purpose of creating Content for your channel:

  1. Advertising campaigns always have to be clearly identifiable as such: Please always pay great attention to use clear terms in your local language, such as “Advertisement” in English speaking countries at the beginning of the post and/or of you content and clearly visible for the viewer.

  2. Whenever there is a payment or similar arrangement (like free of charge delivery), please label your post accordingly and always keep in mind: the influencer/content creator and the brand both can be held accountable for covert advertising and can be subject to substantial fines, including removal of your channel/account from the respective platform.

  3. Any Content shall include a clear and conspicuous disclosure in accordance with the FTC Guides (Federal Trade Commission’s Guides Concerning the Use of Endorsements and Testimonials in Advertising – https://www.ftc.gov/sites/default/files/attachments/press-releases/ftc-publishes-final-guides-governing-endorsements-testimonials/091005revisedendorsementguides.pdf), as well as the rules, regulations and policies of each applicable digital and/or social media platform, including with respect to disclosures necessary to clearly and conspicuously indicate to consumers that Influencer received consideration in exchange therefore, as well as any other applicable advertising disclosures required by applicable law.

  4. Omeda are in no way responsible nor shall Omeda be held accountable for your content and your channel. By using Omeda products and brands for your channel, you herewith agree to keep yourself always informed about the applicable legal requirements in your respective country and always abide by the applicable law. ALL OMEDA PROPERTY IS PROVIDED ON AN AS-IS BASIS WITH NO WARRANTIES, INCLUDING BUT NOT LIMITED TO, ANY WARRANTIES OF NON-INFRINGEMENT.

  5. Each violation of these Terms, our Code of Conduct, applicable law and regulation and/or our instructions regarding the Content or our Property may result in the withdrawal of our permission to use our products and brands in your content and the corresponding content has to be removed immediately from your channels/accounts. We explicitly reserve the right to revoke our given permission at any time and without specific reasons.

  6. We would like to advise you that you are solely responsible for ensuring the compliance of your Content with applicable local law.

  7. For the purposes of this Agreement, “Omeda Property” means (a) the trademarks, trade names, service marks, logos, symbols, designs, slogans, social media and online profiles and handles, in-game “creator accounts” and other indicia of identity or origin (whether registered or not) of Omeda and (b) any other content or intellectual property provided, made available, or directed to be included in the Content. All Omeda Property are, and will remain, the sole and exclusive property of Omeda. Solely in connection with the Content and subject to the terms of this Agreement, Omeda hereby grants to you (“Licensees”), a limited, revokable, non-exclusive, royalty-free, worldwide license to use, distribute, display, perform, reproduce, and prepare derivative works of the Omeda Property.

  8. You as the creator are the exclusive owner of your Content, subject to a worldwide, in perpetuity, royalty-free, sublicensable and transferable license to Omeda Studios to use, distribute, display, publish, and reproduce your name, biographical information, personal characteristics, statements, testimonials, and social media and online profiles and handles (“Likeness”) and the Content throughout the internet, including on our websites and social media channels, solely in connection with, and for purposes of sharing and promoting, our products and/or the Content connecting to our products.

  9. Lastly we would like to inform you that we will not contact or otherwise take any action against or support your claim against platforms (e.g. YouTube) if your content is blocked and/or removed by the platform itself – this applies especially if music from third parties is used in your Content.

Predecessor Creator Guild

1. Entry

Only applications submitted through the official application form will be considered. Recommendations are welcome, but do not guarantee acceptance into the program.

Successful applicants should expect to hear back within 30 days.

2. Expected Behaviour

  • No racism, sexism, discrimination or other illegal content, such as insults or hate messages.

  • No links to illegal content, in particular websites or service providers whose business model is mainly about enabling copyright infringement (e.g. illegal downloads).

  • No commercial exploitation apart from advertising/promotion.

  • Channel operators must comply with the corresponding age rating of the displayed videogame.

  • No content that contains or promotes behaviour such as cheating, exploiting or datamining content.

  • Please be respectful to all members of the Creator Guild. If you experience or witness behaviour that makes you feel unsafe, please report it to a member of staff or contact us at creators@omedastudios.com

Excessive, aggressive or extended negativity against our brand, staff or other creators might result in fewer opportunities being provided to you or your complete removal from the program at our discretion.

3. Confidentiality

As part of the Creator Guild you may be invited to participate in unannounced playtests and opportunities or you may become privy to information that regular players might not have immediate access to.

In order to maintain confidentiality, all members of the Creator Guild will be subjected to an NDA (non-disclosure agreement) forbidding the sharing of such information without explicit and prior consent from Omeda.

We ask that you respect the privacy of staff members that may engage with you and your fellow Content Creators. 

4. Creator Accounts

  1. At certain reward tiers, members of the Creator Guild may receive in-game items such as Silver or Gold Creator Keys that unlock substantial amounts of game content for free. By redeeming such items, you hereby consent to the account you redeem the item on becoming flagged as a 'Creator Account', subjecting it to additional terms and conditions.

5. Violation and Termination

  1. If you bring yourself and/or Omeda into disrepute, or violate any agreed Terms you may be removed from the Creator Guild at the sole discretion of Omeda.

  2. Once removed, you will lose access to any owned 'Creator Accounts', which will be permanently deleted.

6. Data Protection

We will store and process your data only for the purposes of our agreement. We will save your information in our databank to contact you for future projects. If you do not like to be in our Influencer databank, please send us a request and we will delete your data permanently.

We further process your address in order to send you our products or merchandise related to our products. If you do not wish to receive any products from us, please send us a request and we will delete your data and remove you from the Creator Guild.
